Auction Terms & Conditions
Subject Property:  Bidders to Meet at the Quarry on Holland Road in Union, CT West of Exit 74 off I-84, Subject property located in Holland and Sturbridge, MA
Auction Date:  7/25/2017 at 11:00 AM
  1. All prospective Buyers are required to register with the auctioneer and display the required deposit check in order to bid and to obtain a Bid Number.
  2. The Property Auction sale is not contingent on the Buyer obtaining financing, nor conditional upon inspection, and will not be extended for any purposes whatsoever.
  3. If you are a successful bidder, a non-refundable deposit of $10,000 will be due and payable at the conclusion of the Auction in the form of bank cashier's or certified check, money order, or bank draft. The successful bidder will not be entitled to any interest earned on the deposit. At the conclusion of the Auction, the successful Bidder will immediately enter into a Sales Agreement, and be bound to the Terms & Conditions as set forth in the Sales Agreement. In the event of a default by the buyer all deposits paid by the buyer shall be forfeited to the use of the seller. The seller retains the right to pursue any and all remedies against the buyer in the event of a default by the buyer. All Property(s) is being sold "AS IS" condition. Bidders are encouraged to review all Property details, zoning restrictions, compliance certificates, inspection reports, and any other information prior to attending the Auction.
  4. All sales are final.
  5. Descriptions made by the Auction Company during the marketing of this property are made as accurately as possible, but are not guaranteed. Any materials or information has been provided for informational purposes only and neither the auctioneer, the foreclosing mortgagee, nor counsel to such entities makes any representations or warranties as to the accuracy of any of the information provided. It is the sole responsibilty of the prospective bidders to conduct their own due diligence and make their own determinations. The Auction Company reserves the right to deny any person admittance to, or expel any person from the Auction premises, or to withdraw any or all Property(s), or to change the Terms & Conditions, or to reopen bidding on the Property, or may designate one of the Bidders as the successful Bidder, at any time prior to or during the course of the Auction, without just cause.
  6. Bidders acknowledge that they are on the Sale site at their own risk. No person shall have any claims against the Auction Company, its staff and representatives, including its Agents for any injuries sustained or for any damages to or loss of property which may occur.
  7. In the case of dispute, the Auctioneer's decision shall be final.
